This Privacy Policy sets forth how Vivastream, Inc. (“Vivastream”) collects, uses and discloses information, including personally identifiable information (“User Information”) that we may obtain about you through the use of Vivastream services (“Services”) such as but not limited to Vivastream Intelligence Engine and Vivastream Exhibitor Leads Engine, provided through ai.vivastream.com, collectively referred to as (“Site or Sites”).
The use of information collected through our Platform shall be limited to the purpose of providing you the service for which the client has engaged Vivastream. It also describes the choices available to you regarding our use of your personal information, and how you can access and update this information. By using these Sites and Services you acknowledge that you have reviewed and agree to the terms of this Privacy Policy. Do not use our Site and Services if you disagree with our Privacy Policy practices.
Vivastream may update this policy periodically to reflect changes to our information practices. Please check back frequently to see if our Privacy Policy has changed. If we make any material changes to our policy, we will notify you on all applicable Sites and subdomains to which this Privacy Policy applies. By using any of the Sites, you indicate your understanding and acceptance of the terms of the Privacy Policy posted at the time of your use. Vivastream Platforms such as Audience Intelligence Engine, collect information under the direction of its Clients, and has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to Vivastream’s client (the data controller). If you submit a request to have your data removed to us, we will respond to this request within 30 days. If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the Client that you interact with directly. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients. We will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. Vivastream will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
You have control over your personal information, but our Sites include instances where we must have your personal information in order for us to grant you access to the platform, activity and content, to assist us in providing you support or Services, or to apply for Jobs. When you provide us with User Information, we collect, use, and disclose it in the ordinary course of our business in accordance with this Privacy Policy.

Vivastream may use User Information for the following purposes: communicating with you, customers, prospects, partners, and others; provision, personalization and customization of Vivastream Sites and Services; assessing performance and making assessments about future purchases; performing marketing activities directly or through a business partner and otherwise communicating information regarding Vivastream Services (where permitted by law); providing registration for and participation in training, events, webinars and conferences; and for facilitating online employment application process.
Vivastream primarily stores User Information in the United States. To facilitate Vivastream global operations, Vivastream may transfer and access such information outside the United States or European Economic Area. In case Vivastream transfers data from one country to another, this Privacy Policy shall apply. You hereby agree that Vivastream may disclose and share User Information to its affiliates, subsidiaries, third party business partners, and service providers only in ways described in this privacy policy. In situations where Vivastream discloses User Information to any third parties acting as service providers or “agents” on behalf of Vivastream, Vivastream will require the recipient to protect and only use the disclosed User Information in accordance with this Privacy Policy. No personal information will be disclosed to other third parties that are not described in this privacy policy without your prior consent.
Vivastream reserves the right to use or disclose information provided as required by law such as to comply with a subpoena, or similar legal process, or if it reasonably believes in good faith that use or disclosure is necessary to protect Vivastream rights, to protect your safety or the safety of others, investigate fraud, or respond to a government request.
If Vivastream is involved in a merger, acquisition, or sale of all of a portion of its assets, you will be notified via a notice on our Sites or the Site to which the change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information applies.
When you submit inquires on our Sites, we obtain information about you from third party sources to identify your state and country, so that your inquiries may be directed to the appropriate representative.
Vivastream is concerned with the security of your User Information and is committed to taking reasonable steps to protect it from unauthorized access and use of that personal information. To that end, we encrypt the transmission of your sensitive personal information including your login credentials. Additionally, we put in place the appropriate physical, electronic and managerial policies and procedures designed to secure your personal User Information. No method of transmission over the Internet, or method of electronic storage, is one hundred percent secure. Therefore, while we strive to use commercially acceptable means to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, we cannot guarantee its absolute security.

Access to certain content on our Sites may be allowed under a written agreement between you and Vivastream, and may require a username or password issued by Vivastream. In some cases, failure to provide personal information may prevent you from accessing certain Vivastream Sites or Vivastream Services. By accessing and using our protected and secured Site(s), you agree to maintain the confidentiality of the username and password you selected to access such site(s) and consent to our standard terms and conditions applicable to Vivastream Services.
Although we are not obligated to do so, we may review your communications with respect to the Sites and Services to determine whether you comply with the applicable terms of Vivastream Services. Vivastream will not have any liability or responsibility for the content of any communications you provide, or for any errors or violations of any laws or regulations by you.
As is true of most Sites, we gather certain information automatically and store them in log files. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, or Site functionality.
Vivastream and our third party partners such as affiliates and service providers use technologies such as JavaScript, local storage (LS), web beacons and cookies. By using our Sites, you accept the use of these tracking technologies.
JavaScript is a dynamic object oriented computer programming language. JavaScript is used to understand user behavior on our Sites.

Web beacons are a clear graphic image of 1×1 pixel that is delivered through a web browser usually as part of a web page request or an email. Web beacons operate as a tag that records an end users interaction with a web site or email.
